1. Scope
These Terms of Service ("Terms") govern your use of the mobile application "Kairo" ("App") and the website kairocalories.com ("Website"), operated by:

By registering for or using our services, you agree to these Terms. If you do not agree, please do not use our services.
2. Description of Services
Kairo is a calorie and macronutrient tracking app that provides the following features:
- AI-powered food recognition through image analysis
- Manual meal logging
- Barcode scanning for packaged foods
- Calculation of personal nutrition goals based on your body data
- Progress tracking and streak system
- Groups feature for shared tracking
- Apple HealthKit integration (optional)
- iOS Home Screen Widgets
3. Registration and Account
Registration
To use Kairo, you must create a user account. Users under 16 years of age require the consent of a parent or legal guardian. When registering, you agree to:
- Provide accurate and complete information
- Keep your account information current
- Keep your login credentials confidential
- Notify us immediately of any unauthorized use of your account
Responsibility
You are responsible for all activities that occur under your account. We are not liable for losses due to unauthorized use of your account.
4. Subscriptions and Payments
Free Trial
Kairo offers a 3-day free trial with the yearly subscription. During the trial, all features are available without restriction. If the subscription is not cancelled before the trial ends, the regular subscription will be activated.
Premium Subscription
Premium subscriptions are processed through the Apple App Store. By purchasing, you agree:
- Payment will be charged to your Apple ID
- Subscriptions automatically renew unless cancelled at least 24 hours before expiration
- You can manage your subscription in iOS Settings
- No refunds are provided for partial subscription periods
Trial Period
We may offer a free trial period. After the trial ends, the regular subscription will automatically begin unless you cancel beforehand.
Prices
Current prices are displayed in the App Store. We reserve the right to change prices with reasonable notice.
5. Right of Withdrawal
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.
Exercising the Right of Withdrawal
To exercise your right of withdrawal, you must inform us (Valentin Weinert, Dr.-Rohmer-Weg 11, 65719 Hofheim am Taunus, Email: support@kairocalories.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email).
To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising your right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments we have received from you without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal.
Special Note for Digital Content
For in-app purchases through the Apple App Store, Apple's refund policies apply. You can request refunds through your Apple account or at reportaproblem.apple.com. Please note that the right of withdrawal may expire for digital content if you have expressly consented to immediate provision and simultaneously confirmed your knowledge of the loss of the right of withdrawal.

6. Subscription Cancellation (§ 312k BGB)
You can cancel your subscription at any time. Since subscriptions are processed through the Apple App Store, cancellation is done through iOS Settings:
- Open iOS Settings
- Tap your name (Apple ID)
- Tap "Subscriptions"
- Select the Kairo subscription
- Tap "Cancel Subscription"
Alternatively, you can contact us at support@kairocalories.com and we will assist you with the cancellation.
7. Terms of Use
Acceptable Use
You agree to use our services only for lawful purposes. You may not:
- Violate any laws or regulations
- Infringe on the rights of others
- Abuse or disrupt our services
- Attempt to gain unauthorized access
- Transmit harmful software or content
- Reverse engineer or decompile the app or its components
- Use automated systems to access our services
- Impersonate another person or entity
User Content
You retain ownership of content you upload (such as meal photos). By uploading, you grant us a license to process this content to provide our services.
8. Health-Related Disclaimers
Important Notice
Kairo is a nutrition tracking tool and is NOT a medical device within the meaning of Regulation (EU) 2017/745 (EU MDR). The app is not intended to diagnose, treat, cure, or prevent any disease.
Data Accuracy
AI-based food recognition (Google Gemini) and the resulting nutritional calculations are automated estimates and may differ from actual values. In particular:
- AI estimates of portion sizes and nutritional values may be inaccurate
- Kairo must not be used as the sole source of nutritional information
- Consult a doctor or dietitian before making dietary changes
- Do not rely solely on the app for medical or health-related decisions
- Seek professional advice for health concerns
Liability for Health Consequences
Liability for health consequences based solely on the use of AI estimates from the app is excluded to the extent permitted by law. This does not apply in cases of intent or gross negligence.
Health Data Processing
To calculate your personal nutrition goals, Kairo processes your body data (weight, height, age, sex) as health data pursuant to Art. 9(2)(a) GDPR. This data is stored exclusively in our EU database and used solely for this purpose. You may withdraw your consent at any time by deleting your account or contacting us at support@kairocalories.com.
9. Intellectual Property
Ownership
The app, including all content, features, and functionality, is owned by Valentin Weinert and is protected by international copyright, trademark, and other intellectual property laws.
License
We grant you a limited, non-exclusive, non-transferable license to use the app for your personal, non-commercial use in accordance with these Terms.
Restrictions
You may not:
- Copy or distribute app content without permission
- Modify the app or its components
- Use our trademarks or branding
- Create derivative works based on the app
10. Liability
Unlimited Liability
We are liable without limitation for damages arising from injury to life, body, or health resulting from a negligent or intentional breach of duty by us or our legal representatives or agents. We are also liable without limitation for damages caused by intent or gross negligence, as well as under the provisions of the German Product Liability Act.
Liability for Breach of Essential Contractual Obligations
In the event of a breach of essential contractual obligations (cardinal obligations) due to slight negligence, our liability is limited to the foreseeable, contract-typical damages. Essential contractual obligations are those whose fulfillment enables the proper performance of the contract in the first place and on whose compliance you may regularly rely.
Exclusion of Liability
Otherwise, liability for slight negligence is excluded.
Maximum Liability Amount
In cases of limited liability, our total liability is limited to the amount you paid us in the 12 months preceding the damage, but at least €100.
Data Loss
For loss of data, we are only liable up to the amount that would have been incurred for data recovery had you properly and regularly backed up your data.
11. Termination
By You
You can delete your account at any time through the app settings or by contacting us. Upon deletion:
- Your access to the app will be terminated immediately
- Your data will be deleted according to our privacy policy
- Active subscriptions will remain until the end of the billing period
By Us
We may suspend or terminate your account at any time for cause, including violation of these Terms. Upon termination by us:
- We will notify you where legally permitted
- You may still request a copy of your data
- There is no entitlement to refund of ongoing subscriptions
12. Changes to Terms
We may update these Terms from time to time. For significant changes, we will notify you by email or app notification. Continued use after such changes constitutes acceptance of the new Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of your country of residence remain unaffected.
The place of jurisdiction for disputes is, to the extent permitted by law, Frankfurt am Main, Germany. This does not apply if you are a consumer residing in another EU member state.

14. Dispute Resolution (§ 36 VSBG)
Pursuant to § 36(1) No. 1 VSBG (German Consumer Dispute Resolution Act), we are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely achieves the intended economic purpose.
